Terms of Use

These Terms of Use (the "Terms") cover nearbaserentals.com and community.nearbaserentals.com (together, the "site"). The site is operated by Near Base Rentals (the operator of this site), called "we" or "us" here. By using the site, you agree to these Terms. If you don't agree, please don't use the site.

1. Who can use the site

You must be at least 18 years old, or the age of majority where you live if that is higher. By using the site, you confirm that you are.

2. What the site is (and isn't)

Near Base Rentals helps people find rentals within about 25 miles of U.S. military bases. The site is for information only.

• We are not a landlord, real estate broker, agent or property manager.
• We are not a party to any lease, rental agreement or payment between you and anyone else.
• We don't screen, inspect or guarantee any property, landlord or renter.

Verify everything before you sign or pay

Listings, rents, availability, photos, BAH figures, distances and drive times on the site are approximate. They come from landlords, public data sources and Department of Defense rate tables, and they can be wrong or out of date. Check every detail yourself with the landlord and official sources before you sign anything or pay anything.

3. Not affiliated with the military

Near Base Rentals is not affiliated with, endorsed by or sponsored by the U.S. Department of Defense, the Department of Homeland Security or any branch of the U.S. military. Base names are used for reference only, to describe locations. No endorsement is implied.

4. Fair housing

Listings may be marketed to military renters, but every listing must be open to all qualified renters. Landlords must follow the federal Fair Housing Act and all state and local fair housing laws. You may not refuse to rent, set different terms, or advertise a preference based on race, color, religion, sex (including sexual orientation and gender identity), national origin, familial status, disability, or any other class protected where the property is located.

5. Content you post

"Your content" means anything you submit to the site, including listings, photos, reviews, PCS board posts, forum posts, feedback, survey answers and messages.

• You keep ownership of your content.
• You are responsible for your content and for making sure it is accurate and lawful.
• You must have the right to post it, including any photos.

Our license to your content

You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, display, reformat, translate and share your content in order to run, improve and promote the site. This includes showing listings and reviews publicly and sharing renter requests as described in our Privacy Policy. For feedback and survey answers, we may publish summaries or short excerpts without your name or contact details. This license lasts as long as your content is on the site, plus a reasonable time to remove it from backups, and for summaries we have already published.

We may edit content for format or length, decline to post it, or remove it at any time.

6. Rules for landlords and property managers

If you list or claim a property, you confirm that:

• you own the property or are authorized by the owner to rent it and to list it;
• you own the photos you upload or have permission to post them;
• the listing is real, available as described, and priced honestly;
• you will follow fair housing laws and all other laws that apply to renting the property; and
• you will respond honestly to renters who contact you and will use their information only to discuss renting to them.

7. Prohibited content and conduct

Don't post, send or do any of the following:

• Housing discrimination or anything that violates fair housing laws, including statements of preference or limitation based on a protected class.
• Scams, including asking for wire transfers, gift cards, crypto, or a deposit or application fee before the renter has been able to view the property or verify the landlord.
• False, misleading or duplicate listings, or listings for property you have no right to rent.
• Harassment, threats, hate speech or abuse.
• Someone else's personal information (such as a phone number, address, orders or unit details) without their permission.
• Material that infringes someone's copyright, trademark or other rights, including photos or text copied from other websites.
• Defamatory statements, or fake reviews, including reviews of your own property or a competitor's.
• Spam, malware, or automated scraping, posting or account creation.
• Pretending to be someone else, or falsely claiming to be military-affiliated or a government agency.

We may remove content, limit features, or suspend or end access for anyone who breaks these rules.

8. Reporting a problem or requesting a takedown

If you see content that you believe is a scam, discriminatory, defamatory, infringing or otherwise breaks these Terms, email leads@nearbaserentals.com. Please include:

• a link to the page or post (or a clear description of where it is);
• what the problem is and why you believe it breaks the law or these Terms;
• your name and a way to reach you; and
• any supporting information you have.

On the community forum, you can also use the Report button on any post.

We review reports and may remove or hide content, ask the poster for more information, or leave the content up if we don't find a problem. We may not be able to reply to every report, and we can't give legal advice. For copyright claims, please use the DMCA process below.

9. Copyright and DMCA

We respect copyright and respond to notices under the Digital Millennium Copyright Act (DMCA). Send copyright notices to:

Filing a notice

If you believe content on the site infringes your copyright, send a written notice that includes:

1. your physical or electronic signature;
2. a description of the copyrighted work you believe was infringed;
3. the location of the infringing material on the site (a link is best);
4. your name, mailing address, phone number and email;
5. a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law; and
6. a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner.

Filing a counter-notice

If your content was removed and you believe that was a mistake or misidentification, you may send a counter-notice that includes:

1. your physical or electronic signature;
2. a description of the material that was removed and where it appeared before removal;
3. a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
4. your name, address and phone number; and
5. a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the U.S., any judicial district where we may be found), and that you will accept service of process from the person who sent the original notice or their agent.

After a valid counter-notice, we may restore the material in 10 to 14 business days unless the person who sent the original notice tells us they have filed a court action. We may end the accounts of repeat infringers. Sending a knowingly false notice or counter-notice can make you liable for damages.

10. Fees

Near Base Rentals is free for renters and landlords and shows no ads.

11. Links to other sites

The site links to property websites, maps, government pages and other third-party sites. We don't control them and aren't responsible for their content, accuracy, privacy practices or availability.

12. No warranty

The site and everything on it are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We don't promise that the site will be accurate, complete, error-free, secure or always available, or that any listing, landlord or renter is legitimate.

13. Limitation of liability

To the fullest extent the law allows, Near Base Rentals and its owners, members, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost money, deposits, rent, profits, data or housing, arising from your use of the site, any listing, or any dealings with a landlord, renter or other user.

To the fullest extent the law allows, our total liability for any claim related to the site is limited to the greater of the amount you paid us in the 12 months before the claim or $100.

Some places don't allow some of these limits, so they may not all apply to you.

14. Indemnity

If you post content or use the site in a way that breaks these Terms or the law, you agree to cover our reasonable losses and costs, including reasonable legal fees, from any resulting claim against us.

15. Ending access

You may stop using the site at any time. To ask us to remove your content or information, email leads@nearbaserentals.com. We may suspend or end access to the site, or remove content, at any time if we believe these Terms have been broken or to protect users or the site.

16. Changes to these Terms

We may update these Terms. When we do, we will change the effective date at the top. If a change is significant, we will make a reasonable effort to give notice, such as a notice on the site. Using the site after a change means you accept the updated Terms.

17. Governing law

These Terms are governed by the laws of the state where the operator of the site is organized, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts of that state, unless the law requires otherwise.

18. Other terms

If any part of these Terms can't be enforced, the rest stays in effect. If we don't enforce a part of these Terms, that isn't a waiver. These Terms and our Privacy Policy are the full agreement between you and us about the site.
